Darnytsia vs Farmak for Corvalolum trademark
Higher Economic Court of Ukraine on August 31 threw out an appeal by Kyiv-based open joint-stock company Farmak against a ruling of Kyiv Economic Court and a ruling of Kyiv Economic Court of Appeals, upholding the right of Kyiv-based closed joint-stock company Darnytsia pharmaceutical firm to the Corvalolum trademark, reads a press release issued on Monday by Pavlenko & Poberezhnyuk law group, which protected the interests of the Darnytsia pharmaceutical firm.
The release says that Farmak since 2005 has been trying to declare illegal certificates for the Corvalolum-Darnytsia trademark in courts of various instances. Its own certificate was received in April 2005.
The lawyers said that the Darnytsia pharmaceutical firm had won cases in Kyiv Economic Court and in Kyiv Economic Court of Appeals.
The courts also established that the chamber of appeals of the state department of intellectual property declared in public that the Corvalolum trademark belonged to Farmak in 2004, and the Education and Science Ministry approved a procedure for declaring trademarks well known only in 2005.
Darnytsia pharmaceutical firm and Farmak are the largest Ukrainian pharmaceutical companies.
