Ad hoc Working Group on the Legal Development of the Hague System for the International Registration of Industrial Designs

From May 30 – June 1, 2011 at headquarter of World intellectual property Organization (Geneva) took place Ad hoc Working Group on the Legal Development of Hague System for the International Registration of Industrial Designs.

At the meeting as observer representative took part Ayagul Abitbekova Head of Examination of Industrial Designs.

Hague System for the International Registration of Industrial Designs helps to facilitate industrial designs patenting procedure by means of filing the one an application to get protection of industrial design in abroad, as well as are an Agreement participants. For nationals and residents of Contracting Parties of Companies established in these countries is not necessary to file national application in every country, where requests the protection. It excludes implementation of various procedures accepted in these countries. Also no need to filing out documents on various languages, to control on re-registration terms by different countries. No need to pay for the number of national fees and operation of Patent Attorneys in every country.

Nowadays the Republic of Kazakhstan is not Member – State of Hague System. The Working Group was assembled for consideration and assignment of recommendation of issues relating to the publication and contents of the International Designs Bulletin and related proposed amendments to the Common Regulations Under the 1999 Act and the 1960 Act of the Hague Agreement, as well as the possibility of acceptance of new Rule on Refusal and consequenses of records on amendments of propietary rights in International Register.

At the morrow of discussion on situation of 1934 Act, representstives of Member – States as Tunisia, Spain and an International Organization ECTA made suggestions on its cancellation linking to difficulty of its compliance of formality requerements snd necessity more easier utilization system. For improvement of Hague system totally Working Group recommended to continue the operation in years 2012 – 2013.
