A commercial court will hear on November 16 an appeal against the amount awarded in Adidas AG's suit to ban Alba Corporation from using "three stripes" trade mark, the court told the Russian Legal Information Agency (RAPSI).
The Moscow Commercial Court, on May 10, partially satisfied the suit from Adidas, the head company of Germany's Adidas Group, and banned Alba Corporation (selling its products through the Alba network) from using the Adidas trademark. Yet the court reduced the amount of compensation from 2.5 million rubles to 250,000 rubles ($8,000).
The appellate court upheld this ruling on August 9.
In court Adidas explained that Alba Corporation was selling footwear bearing Adidas trademark. According to the plaintiff, the Adidas trademark was registered in relation to footwear for sports and outdoor activity and has been known in Russia since 1978.
Alba Corporation disagreed arguing that Adidas right was not infringed because Alba was selling not sports shoes but classic footwear.
Alba network includes over 70 shops in Moscow and other Russian towns. In 1998, Alba began to produce footwear with its own Alba trademark.
