Trademark registration requirements in Ukraine

• Power of attorney simply signed, which may be filed 2 months after filing the trademark registration request.
• Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark) and the explanation of the meaning in the Ukrainian language.
• The details of goods and/or services for witch the trademark will be registered or the classes in case they are known.
• Details of the trademark owner (name, address, registration number).
• Invoicing details (name, address, fiscal number, registration number).
• Certified copy of priority document in case priority is to be claimed, it can be claimed in 3 months from filing.

Trademark registration procedure in Ukraine

After completion of filing procedure the official notification of the receipt of the application is issued within 2-3 months. Then the trademark undergoes substantive examination for about 12-13 months. On condition that the trademark meets the requirements the grant decision is issued. If the registration and publication fees are paid in due course the trademark is registered, published and the certificate of registration is issued within 2-3 months. The total period of trademark registration procedure is from 16 to 19 months. No opposition against the national application can be filed. The protection lasts 10 years from the filing date.

Other trademark procedures in Ukraine

Trademark renewal in Ukraine: The renewal may be done within the 2 months before expiry. For the trademark renewal we need the power of attorney simply signed. After renewal, the protection lasts 14 years.

Trademark change in Ukraine: For changing the name or address we need the power of attorney signed and notarized under the new name, and the official document certifying the change of name.

Trademark assignments in Ukraine: For the assignment we need the power of attorney signed by both parties, the deed of assignment singed by both parties notarized in Ukrainian language. Assignments may be done with or without Goodwill. Pending applications and unregistered trademarks may not be assigned.

Trademark use in Ukraine: When a registered trademark has not been continuously used for the goods or services concerned for 3 years from the date of registration, a cancellation action may be filed by a third party.
