Trademark registration requirements in Turkey
- Power of attorney simply signed.
- Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
- The detaliation of goods and/or services for witch the trademark will be registered or the the classes in case they are known.
- Details of the trademark owner (name, address, registration number).
- Invoicing details (name, address, fiscal number, registration number).
- Certified copy of priority document in case priority is to be claimed.
Trademark registration procedure in Turkey
The trademark registration procedure in Turkey lasts 14 – 18 months. The trademark will be published in the Official Industrial Property Journal. The opposition can be filed within 3 months. The protection lasts 10 years from the filing date.
Other trademark procedures in Turkey
Trademark renewal in Turkey: The renewal may be done within the 6 months before expiry. For the renewal we need the power of attorney simply signed. After trademark renewal, the protection lasts 10 years.
Trademark change in Turkey: For changing the name or address we need the power of attorney simply signed, the certificate of change of name duly notarized and the original trademark registration certificate for endorsement purposes.
Trademark assignments in Turkey: For the trademark assignment we need the power of attorney simply signed, the deed of assignment notarized, the activity certificate in the name of assignee issued by chamber of commerce. Assignments may done with or without Goodwill. Pending trademark applications may be assigned. Unregistered trademarks may not be assigned. A tax is payable only if either parties has Turkish nationality.
Trademark use in Turkey: Non-use for 5 years following the date of registration or for any other uninterrupted 5 year period leaves the mark vulnerable to cancellation
