Trademark registration requirements in Tajikistan

• Power of attorney simply signed power of attorney, it can be filed in 2 months after the application.
• Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).
• The details of goods and/or services for witch the trademark will be registered or the classes in case they are known.
• Details of the trademark owner (name, address, registration number, the explanation or the meaning and origin of the trademark).
• Invoicing details (name, address, fiscal number, registration number).
• Certified copy of priority document in case priority is to be claimed, it can be filed in 3 months from filing.

Trademark registration procedure in Tajikistan

The registration procedure lasts 5 years. The opposition can be done in 60 days after the publication. The protection lasts 10 years from the filing date.

Assignments may be done with or without Goodwill. Pending applications may be assigned. Unregistered marks may not be assigned.

Trademark use in Tajikistan: When a registered mark has not been continuously used for the goods or services concerned for 3 years from the dare of registration (or the date of the last use) a cancellation action may be filed by an interested person. The request may relate to all or part of the goods specified in the certificate of registration and will be ruled on by the Board of Appeals.
